Supreme Court stays transit bail granted to Congress leader Pawan Khera by Telangana High Court in the case filed by Assam Police

On Wednesday, April 15, the Supreme Court of India stayed the anticipatory transit bail granted to Congress leader Pawan Khera by Telangana High Court. The bail was granted by Telangana High Court over an FIR registered by the Assam Police on Assam CM Himanta Biswa Sarma’s wife, Riniki Bhuyan Sharma, over Khera’s allegations that she held multiple passports of different countries.

A bench comprising Justices J.K. Maheshwari and Atul S. Chandurkar of the Supreme Court issued notice to Khera, directing him to file his response within three weeks on the plea seeking a stay of the anticipatory (transit) bail earlier granted by the Telangana High Court.

However, the apex court also noted that it won’t come in the way if Pawan Khera wants to apply bail in Assam.

The Supreme Court order came after the Assam government approached the apex court to contest the relief granted to Khera by Telangana High Court and sought its suspension.

The Supreme Court noted, “Issue notice. Meanwhile, the impugned order should be stayed. In case the petitioner applies for anticipatory bail before the court having jurisdiction in Assam, and while deciding such an application, the order passed today will not have any effect. Issue notice. Returnable in three weeks.”

Notably, Congress leader Pawan Khera had alleged that the wife of Assam CM Himanta Biswa Sarma has 3 passports, after which a case was filed against him. Khera, instead of providing any proofs, has been avoiding Assam Police since then after a case was filed.
